Introduction & Definitions
These Terms & Conditions govern all reservations, payments, and participation in activities offered by Drake Bay
Diving. By making a reservation, completing a payment, or participating in any activity, the client confirms that
they have read, understood, and fully accepted these Terms & Conditions.
“Drake Bay Diving” refers to the diving and snorkeling operator providing services through its website, booking
platforms, and physical location in Costa Rica.
“Client / Customer / Participant” refers to any individual who makes a reservation, completes a payment, or
participates in an activity offered by Drake Bay Diving.
“Activity” refers to any service provided by Drake Bay Diving, including but not limited to scuba diving, snorkeling,
tours, or related experiences.
1. Payments
Reservations may require either a deposit or full payment, depending on the selected booking option. Once a
reservation is confirmed, operational costs such as national park entrance fees, permits, logistics, and staff
scheduling are incurred and allocated to the specific booking.
2. Changes to a Booking
Requests to modify a confirmed reservation must be submitted in writing via email to info@drakebaydiving.com.
All changes are subject to availability and may incur additional charges.
3. Cancellation Policy
All cancellations must be submitted in writing via email. If full payment has been made, cancellations at least 24
hours prior to the activity receive a 50% refund. Cancellations made less than 24 hours prior receive no refund.
Deposits are non-refundable due to operational costs incurred upon confirmation.
4. No-Shows & Late Arrivals
Failure to arrive on time or failure to show up will be treated as a last-minute cancellation with no refund. Clients
are responsible for arriving at the agreed meeting point on time.
5. Limited Capacity
Drake Bay Diving operates with limited capacity to ensure safety and high-quality experiences. Each confirmed
reservation blocks availability for a specific date and time.
6. Weather & Safety Conditions
Drake Bay Diving reserves the right to cancel or modify any activity if conditions are unsafe. In such cases, clients
receive a 100% refund. Voluntary cancellations by the client due to personal reasons are non-refundable. All
safety decisions are final.
7. Waivers & Liability
All participants must sign a liability waiver prior to participation. Refusal to sign results in denial of participation
without refund. The waiver does not exempt Drake Bay Diving from responsibility in cases of gross negligence or willful misconduct under Costa Rican law.
8. Force Majeure
Drake Bay Diving is not liable for cancellations or modifications caused by events beyond its control, including
natural disasters, government actions, or park closures.
9. Applicable Law
These Terms & Conditions are governed by the laws of Costa Rica. In case of discrepancy between language
versions, the Spanish version shall prevail.

TÉRMINOS Y CONDICIONES – DRAKE BAY DIVING
Introducción y Definiciones
Los presentes Términos y Condiciones regulan todas las reservas, pagos y la participación en las actividades
ofrecidas por Drake Bay Diving. Al realizar una reserva, efectuar un pago o participar en una actividad, el cliente
reconoce haber leído, comprendido y aceptado íntegramente estos Términos y Condiciones.
“Drake Bay Diving” se refiere al operador de buceo y snorkeling que presta servicios a través de su sitio web,
plataformas de reserva y ubicación física en Costa Rica.
“Cliente / Participante” se refiere a cualquier persona que realiza una reserva, efectúa un pago o participa en una
actividad ofrecida por Drake Bay Diving.
“Actividad” se refiere a cualquier servicio brindado por Drake Bay Diving, incluyendo buceo, snorkeling, tours u
otras experiencias relacionadas.
1. Pagos
Las reservas pueden requerir un depósito o el pago total. Una vez confirmada la reserva, se generan costos
operativos no recuperables.
2. Modificaciones de una Reserva
Toda solicitud de modificación deberá realizarse por escrito al correo info@drakebaydiving.com. Las
modificaciones están sujetas a disponibilidad.
3. Política de Cancelación
Las cancelaciones deben realizarse por escrito. Pagos totales cancelados con al menos 24 horas reciben un
reembolso del 50%. Cancelaciones tardías o depósitos no son reembolsables.
4. No Presentación y Retrasos
La no presentación o el retraso se considerará cancelación de último momento sin derecho a reembolso.
5. Capacidad Limitada
Cada reserva confirmada bloquea cupos específicos para una fecha y horario determinados.
6. Condiciones Climáticas y Seguridad
Drake Bay Diving podrá cancelar actividades si las condiciones no son seguras. En estos casos, se otorgará un
reembolso del 100%.
7. Exoneración de Responsabilidad
Todos los participantes deberán firmar un waiver. La firma no exime de responsabilidad en casos de negligencia
grave o dolo.
8. Fuerza Mayor
Drake Bay Diving no será responsable por eventos fuera de su control.
9. Legislación Aplicable
Estos Términos y Condiciones se rigen por la legislación vigente en Costa Rica. En caso de discrepancia entre
idiomas, prevalecerá la versión en español.
